Example 34. A question arose regarding valuable artworks in a museum funded by a municipality.60 After the city became bankrupt, a city “emergency manager” wanted to list some of the valuable artworks in the museum’s collection as possible assets available to pay the city’s debts. A public outcry followed wherein concerned citizens asserted that art collections are important cultural resources that should never be treated as disposable assets. They quoted the provision in the AAM Code of Ethics for Museums,61 which states a museum’s disposal of any of its collection through sale must be solely for the advancement of the museum’s mission and proceeds from a sale can only be used for acquisitions or for direct care of the collection. The state Senate then passed a bill that would prohibit a municipal museum from selling any of its artworks unless the sale was in connection with a relocation of the art collection to a comparable facility within the same municipality. The Senate bill stated that a governmental museum must adhere to the AAM Code of Ethics for Museums.
